1. No purchase necessary. Eligible persons may enter by completing and submitting an original entry form available online at www.thekit.ca. This contest will live on www.thekit.ca and all entries must be received online. To participate, fully complete the Official Entry Form. Limit of one entry per person per day. All entries become the property of THE KIT and none shall be returned. Proof of sending entry shall not be proof of receipt.
2. This contest starts on September 15, 2010 12:00:01 am ET and ends on March 15, 2011 11:59:59 pm ET (the “Contest Period”).
3. Eligibility: This Contest is only open to all legal residents of Canada who are age 18 or overhave reached the age of majority and excluding employees of THE KIT, the Prize Sponsors, contest judges and their respective fulfillment, interactive, advertising and promotional agencies, representatives, persons with whom any of the above are domiciled and/or members of their respective immediate families (immediate family means parents, siblings, children and spouse).
The Regis Des Alcools monitors and regulates any contests open to Quebec residents. Any litigation respecting the conduct and organization of a publicity contest may be submitted to the Règie des Alcools des Courses et des Jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Règie only for the purpose of helping the parties reach a settlement. Participants in the contest agree to abide by these rules and all decisions of THE KITand the prize sponsors.
4. Prize Details: The prize consists of an accessory from the latest Oscar de la Renta collection, a 7.5 mL bottle of the original Oscar de la Renta perfume and round-trip airfare to New York City to pick up the prize from the Oscar de la Renta office on 7th Avenue. The round-trip airfare will be provided from an airport closest to winner’s home (in Canada only). Total value of the prize is $1500 CDN.
5. To be eligible for the prize, entries must be received during the Contest Period. The Contest Sponsors are not responsible for any entries that are incomplete, lost, destroyed, delayed, or not transmitted due to technical failure, however caused. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed submitted by the authorized account holder of the e-mail address at the time of entry. “Authorized account holder” is the natural person who is assigned the e-mail address by the internet service provider or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question.
6. Selection Process: The potential winnerwill be selected by random draw from among all eligible contest entry forms. Attempts will be made to contact selected entrant by phone or e-mail within 72 hours of the draw. In the event that a selected entrant does not comply with these Contest Rules and Regulations, or cannot be contacted within 72 hours of the draw, that selection shall be void and the entrant will be disqualified from the Contest and will not win a prize, and an alternate entrant will be selected from the remaining entries and the above procedure followed until an eligible entrant is selected. The chances of winning are dependent upon the total number of eligible entries received. The prizes must be accepted as awarded, may not be sold, are non-transferable and cannot be redeemed for cash. The Contest Sponsor reserves the right to substitute all or any portion of the prize with a prize of approximately equal or greater value in the Contest Sponsor’s sole discretion, acting reasonably. All applicable federal, provincial and municipal taxes are the sole responsibility of the winner.
7. The selected entrantwill be required to correctly answer a time limited mathematical skill testing question before being declared a prizewinner. The potential prize winner must sign and return, within 7 days of receipt, a declaration of compliance with the contest rules and a release of liability in favour of the Contest Sponsor, the Prize Sponsors, THE KIT, contest judges, their respective subsidiaries, affiliates and fulfillment, interactive, advertising and promotional agencies, and each of their respective officers, directors, employees, representatives and agents (collectively, the “Group”) in the form provided by the Contest Sponsor (“Declaration and Release”) as a condition to and in advance of receiving the prize such that none of them shall be liable for the use or misuse of the Prize. By entering the contest, each entrant acknowledges and agrees that the Group shall have no liability of any kind with respect to this contest and/or the awarding or use of any prize, and shall not be liable for claims, demands, actions, loss, personal injury, including death, or damage of any kind resulting from the acceptance, possession or use/misuse of the prize or otherwise from such entrant’s participation in the contest. In the event that the potential winner does not correctly answer the mathematical skill testing question within the time limit, does not sign and return the Declaration and Release form within 7 days of receipt, the Contest Sponsor shall have the right to disqualify that potential winner and that potential winner will not win a prize, and the Contest Sponsor may draw an alternate potential winner from all remaining eligible entries received, and the Contest Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.
8. Participation in the contest constitutes permission to the Contest Sponsor and their agencies to use the name, photograph and/or likeness of the winnerfor purposes of promotion, advertising, and trade without further compensation.
9. By participating in this contest, all entrants agree to be bound by these Rules and Regulations. The decisions of THE KIT and the contest judges are final and binding on all entrants. The Contest Sponsor is not responsible for any typographical error in the printing, the offering or the administration of the contest nor will any responsibility be taken for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, failed, incomplete, garbled or delayed computer transmissions, whether caused by the Contest Sponsor, users or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit a participant’s ability to participate in the contest. Contest Sponsor is not responsible for damage to a user’s system occasioned by downloading any information necessary to participate in this contest. Contest Sponsor reserves the right, in their sole discretion, to cancel, modify, terminate or suspend this promotion should a virus, bug, computer problem, unauthorized human intervention or other cause beyond the Contest Sponsor’s control corrupt or affect the administration, security, fairness or proper play of the contest. The Contest Sponsor reserves the right to withdraw or terminate the contest at any time without prior notice or to change the Rules and Regulations. Contact or correspondence will occur only with selected entrants. This contest is subject to all Federal, Provincial and Municipal Laws and regulations.
